To Legal system intends to be the beginning for those who need to work in a dignified and regular way, but who do not have the qualifications, educational level, or previous experience that are normally required by employers. Many produce their products, and they improve over time, which in many cases makes it possible to leave the streets and formally work with companies or as a micro-entrepreneur/micro-entrepreneur. Tô Legal made it possible to create a new document, the Authorization Ordinance for Commerce and Services (PCS), which is obtained in an agile and simple way, and analyzed automatically by the system.

This permits the use of the public space for a period of up to 90 days. Until 2019, the only way for traders or service providers who work on the streets to formalize themselves was by obtaining a Term of Permission for Use – TPU, a document granted through summons, public call, registration, or public competition, which rarely happened. Only locations determined by the Deputy Mayors could be chosen. For the request for the Authorization Ordinance for trade and provision of services (PCS), the platform facilitates the choice of places and periods in which people want to work; at the same time, by visually displaying activities on a map of services, it shows authorized activities throughout the city. This information can help in choosing the location and the type of trade or service that the worker intends to exercise. It also gives them the chance to try a place and activity to see if it meets their expectations or not.

Aim of the Good Practice

Create an electronic system to issue documents to entrepreneurs who work on the streets of the city of São Paulo; - Create a new type of authorization that allows the sale and provision of services on the streets, issued simply and quickly with automatic analysis; - Facilitate and speed up the issuance of documents for entrepreneurs who work on the streets of São Paulo, with access available via cell phone, tablet and computer; - Democratize the use of public space for different types of entrepreneurs with the most varied profiles, ages, qualifications or professional experience; - Give opportunity to formalize as an entrepreneur; - Allow the request for authorizations for different types of commerce and services in a simple and easy way, throughout the territory of the municipality; - Make payment guides and requests available online to avoid unnecessary trips; - Give transparency to issued documents by displaying georeferenced pins on a map.

Implementation period

The system is currently being implemented, in the expansion phase. Tô Legal system was designed to be implemented in phases. The first phase culminated with its implementation, marked by Decree No. 58.831/2019 which provides for the Tô Legal system. It was implemented on 07/01/2019 to issue documents that authorize trade and provision of services on roads and public places. Since then, it has issued documents that are automatically analyzed by the system, while others depend on technical analysis by the Subprefectures, in order to comply with existing legislation. After implementation, more documents were included: for electric scooter sharing stations and door-to-door commerce; for free fairs, markets and municipal grocery stores in 2022, according to Decree No. 61,124/2022. Current stage – In development: transformation of Tô Legal into a Portal and inclusion of the indicative advertisement license, integrations with systems for registering defaulters and overdue debt

Consistency over time

In 2019, Tô Legal controlled and issued 9 types of permits and authorization ordinances, and others were made available over the years. There are currently 14 types of documents: TERM OF USE PERMISSION (TPU) for: street vendor Newspaper, stand flower, stand Street, food, Bike Sharing, Scooter Sharing, Tables, Chairs, and Awnings valet ; open market Municipal market, municipal shopping center. Evaluation of the Good Practice

Tô Legal is monitored daily through reports. It also has a panel (dashboard) with real-time information related to requests, documents issued and collection, among others. Numbers achieved by Tô Legal since 2019: Approximately 45 million pages visited 1084469 hits, 66840 requests made, 57800 documents issued. Over $38 million raised, 2500 monthly reports sent to Subprefectures and SESANA

Key stakeholders and partnerships

Tô Legal e-formalization system is positioned as a fundamental milestone for the transition to the formal economy in the city of São Paulo. Its use by people in vulnerability, especially women, the elderly, young people without experience, aims at their inclusion in the labor market, in order to offer a chance of formalization for those who seek their livelihood in a dignified manner. The system is linked to the concept of decentralization of activities and services in the City of São Paulo, provides for the development of the local economy, increases the supply of formal jobs and provides greater comfort and security for users. The local population can be assisted in their needs, and the worker/entrepreneur has the freedom to choose the days and times to carry out their activity, in places close to their homes, positively impacting the reduction of travel time and associated expenses, resulting in an improvement in the quality of life of this worker. Tô Legal has two types of users : External public: citizens who wish to formalize to trade or provide services in the streets, street markets, markets and municipal grocery stores. Internal audience: employees of the 32 Subprefectures, employees of the Executive Department for Food and Nutritional Security, Supply and Agriculture – SESANA.
